Instagram Giveaway Disclaimer Template / Copy-Paste

You need two disclaimers, not one. A short block that fits in a caption, and a longer version that lives in your hosted terms. Most creators write neither and hope the comment section does not notice.

Below are templates you can copy directly, plus variants for Reels, Stories, multi-brand collabs, photo contests, and age-restricted prizes. Fill the bracketed fields, delete what does not apply, and host the long version somewhere permanent.

Why the Disclaimer Exists

Meta's Promotion Guidelines require every promotion to include a complete release of Instagram by each entrant and an acknowledgment that the promotion is not sponsored, endorsed, administered by, or associated with Instagram. That is the platform half.

The other half is consumer protection law. "No purchase necessary" and "void where prohibited" are not decoration. They are the statements that keep your promotion on the right side of gambling statutes and give you a defence if a regulator or an angry entrant comes asking. A disclaimer does three jobs: it distances Instagram, it sets the legal category of your promotion, and it tells entrants what they are agreeing to.

Template 1: Short Caption Disclaimer

This is the one you paste at the bottom of a giveaway caption. It fits comfortably inside Instagram's character limit alongside your entry instructions.

This giveaway is in no way sponsored, endorsed, administered by, or associated with Instagram or Meta. By entering, you release Instagram from any responsibility for this promotion. No purchase necessary. Open to residents of [COUNTRY / STATES] aged [18]+. Void where prohibited. Entries close [DATE] at [TIME] [TIME ZONE]. One winner drawn at random and announced on [DATE] via [Story / post / DM] from this account only. Full terms: [URL]

Fields to change: country or state list, age floor, closing date and time zone, announcement date and method, terms URL.

Template 2: Ultra-Short Version

For Reels captions and Stories where space is tight. Use it only when the full terms are one tap away.

Not sponsored by or associated with Instagram. No purchase necessary. [18]+, [COUNTRY] only. Void where prohibited. Closes [DATE, TIME ZONE]. Full rules: [URL]

If you cannot fit even this, the giveaway does not belong in that format.

Template 3: Extended Disclaimer for Hosted Terms

This goes on your website, inside your official rules document.

Sponsor and platform release. This promotion is administered solely by [LEGAL ENTITY NAME] ("Sponsor"), [ADDRESS]. It is in no way sponsored, endorsed, administered by, or associated with Instagram, Meta Platforms, Inc., or any of their affiliates or subsidiaries. Each entrant fully and unconditionally releases Instagram and Meta from any and all liability arising out of or relating to participation in this promotion or the acceptance, use, or misuse of any prize. Any questions, comments, complaints, or disputes regarding this promotion must be directed to Sponsor and not to Instagram or Meta.

No purchase necessary. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A purchase will not improve your chances of winning. Void where prohibited or restricted by law.

Eligibility. Open to legal residents of [JURISDICTION] who are [18] years of age or older as of the entry date. Employees, officers, and directors of Sponsor and its parent, affiliates, subsidiaries, and promotional agencies, and the immediate family members and household members of each, are not eligible. [Residents of [EXCLUDED STATES/PROVINCES] are not eligible.]

Winner selection. Winner(s) will be selected in a random drawing from all eligible entries received during the entry period. Odds of winning depend on the total number of eligible entries received. Sponsor's decisions are final and binding on all matters relating to this promotion.

Notification and claim. The winner will be notified by [Instagram direct message from @HANDLE] within [48] hours of the drawing and must respond within [7] days. Failure to respond within that period, or return of any notification as undeliverable, results in forfeiture and the selection of an alternate winner.

Prize terms. Prize is [DESCRIPTION], approximate retail value [ARV]. Prize is non-transferable, non-refundable, and no cash equivalent or substitution will be offered except at Sponsor's sole discretion. All federal, state, provincial, and local taxes on the prize are the sole responsibility of the winner.

Publicity. Except where prohibited, acceptance of a prize constitutes consent for Sponsor to use the winner's username, first name, and city for promotional purposes without further compensation.

Privacy. Information collected from entrants is used only to administer this promotion in accordance with Sponsor's privacy policy at [URL] and is retained for [PERIOD] after the promotion ends.

Agreement. By entering, participants agree to these Official Rules and to the decisions of Sponsor, which are final and binding.

Template 4: Multi-Brand Collab Giveaway

Loop giveaways and joint prize pools need to name every sponsor, because entrants have to know who is liable for what.

This giveaway is hosted by [PRIMARY SPONSOR] in partnership with [BRAND A], [BRAND B], and [BRAND C]. Each partner supplies the portion of the prize described above and is solely responsible for fulfilling that portion. This promotion is in no way sponsored, endorsed, administered by, or associated with Instagram or Meta, and entrants release Instagram from all responsibility. No purchase necessary. Template 5: Photo Contest and User-Generated Content

Once entrants submit content, you need a licence to use it. Silence is not consent.

By submitting an entry, you confirm that the content is your original work, that you own or control all rights in it, and that it does not infringe the rights of any third party. Any identifiable individuals appearing in your entry have consented to its submission and use. You grant Sponsor a non-exclusive, worldwide, royalty-free licence to reproduce, display, and distribute your entry across Sponsor's marketing channels for [PERIOD], with credit to your username where practicable. Sponsor may disqualify any entry it considers offensive, unlawful, or non-compliant with these rules. This promotion is in no way sponsored, endorsed, administered by, or associated with Instagram or Meta. Judging is based on [CRITERIA] by a panel of [NUMBER] judges.

Template 6: Age-Restricted or Alcohol Prizes

Open to legal residents of [JURISDICTION] who are [21] years of age or older at the time of entry. Proof of age is required before the prize is released. The prize will not be shipped to any jurisdiction where the sale or delivery of [PRODUCT CATEGORY] is prohibited. Sponsor reserves the right to substitute a prize of equal value where delivery is not permitted. This promotion is in no way sponsored, endorsed, administered by, or associated with Instagram or Meta.

Where to Put the Disclaimer

Feed posts. Bottom of the caption, above the hashtag block, with the terms link. Not in a reply.

Reels. Caption, plus a legible on-screen text card if the entry instructions are spoken.

Stories. A text overlay on the giveaway frame plus a link sticker to the full terms. Stories expire, which is exactly why the terms have to live elsewhere.

Lives. Say it out loud when you announce the giveaway and put it in the pinned comment.

First comment. Acceptable for the release line if the caption is genuinely full. It is not acceptable as the only home for your full terms.

Mistakes That Undo the Disclaimer

Hosting terms on a document you edit later. Once entries open, the rules are locked. Editing them mid-promotion invalidates the reliance entrants placed on them.

"Rules in comments." Comments move, get buried, and get deleted. Regulators and Meta both expect rules at a stable, publicly accessible URL.

Copying a US disclaimer for a UK or EU audience. "Void where prohibited" is American phrasing. UK promotions need CAP Code disclosures. EU promotions need a GDPR-compliant data statement. Canadian promotions need the skill-testing question clause.

Omitting the sponsor's legal name. Your handle is not a legal entity. If someone needs to file a complaint, they need a name and an address.

Leaving brackets in the published version. It happens more often than you would think, and it makes the whole document look unenforceable.

Filters that contradict the text. If the disclaimer says one entry per person, your draw has to deduplicate. Running the draw through Insta Picker with filters matched to your published wording keeps the two in sync and gives you a record if anyone challenges the result.

Building the Full Document

A disclaimer is a section, not a whole rules document. Frequently Asked Questions

Can I just write "not affiliated with Instagram" and be done?

That covers one requirement of several. Meta also expects a release of Instagram by each entrant, official rules, and eligibility terms. Consumer protection law adds the no-purchase and void-where-prohibited statements. The short caption template above covers all of them in one block.

Does the disclaimer have to be in the caption, or is the first comment enough?

The release line is acceptable in the first comment if your caption is genuinely out of room, and many brands do exactly that. Your full official rules need a permanent URL either way, since comments are not a stable location.

Do I need a different disclaimer for Reels and Stories?

The substance is identical, only the format changes. Reels need the wording legible on screen or in the caption. Stories need an overlay plus a link to the terms, because the frame disappears in 24 hours and your obligations do not.

What if my giveaway is open worldwide?

Worldwide eligibility is harder than it sounds, because you inherit every jurisdiction's rules at once. Most hosts limit entry to a named list of countries, exclude places with registration or permit requirements, and state shipping restrictions explicitly rather than promising delivery everywhere.

Is a copy-paste disclaimer legally binding?

It is a starting point, not counsel. Templates cover the common requirements, but prize value, jurisdiction, entry mechanics, and data collection all change what you need. Anything with a high-value prize or a national audience should be reviewed by a lawyer before launch.
