Welcome to InstaPicker. These terms and conditions are the agreement between you and InstaPicker for using our website and tools. By creating an account or running a draw, you agree to what follows. The service we provide
InstaPicker is an Instagram comment picker. You give us the public link to an Instagram post or reel, and we help you select one or more winners at random from the comments. We provide the tool. You decide how to run your giveaway and you are responsible for it.
Your account
To use most features, you need an account. You agree to give accurate information when you sign up and to keep it current. You are responsible for keeping your login details private and for everything that happens under your account. If you think someone else is using your account, tell us right away at [email protected].
Free trials
Every new account includes 3 free trials so you can test InstaPicker on a real giveaway. The trial lets you run draws subject to any limits we describe at the time. We may change or end the free trial offer in the future, but doing so will not affect trials you have already used.
Plans, pricing, and payment
Details of our paid plans are shown at http://instapicker.com/pricing. When you buy a plan, you agree to pay the listed price for the features described. Payments are handled by a secure third-party processor. Unless we state otherwise, fees are charged in advance and are non-refundable except where the law requires a refund. If a plan renews automatically, we will make that clear before you buy, and you can cancel before the next renewal to avoid further charges. We may update our pricing, and if we do, the new price applies to your next billing cycle, not retroactively.
Acceptable use
We ask you to use InstaPicker honestly and legally. You agree not to use the service to break the law, to run giveaways that are themselves illegal or deceptive, to abuse or overload our systems, to reverse engineer or copy the tool, or to misuse other people's data. You also agree to run your giveaways fairly and to honor the prizes you offer. If you use InstaPicker to mislead your audience, that is on you, not us.
Following Instagram's rules
InstaPicker is an independent tool. We are not affiliated with, endorsed by, or sponsored by Instagram or Meta. When you run a giveaway, you are responsible for following Instagram's own promotion guidelines and terms, as well as any laws about contests and prizes where you and your entrants live. We strongly recommend you read Instagram's promotion rules before you launch.
Your content and data
You keep ownership of the giveaways you run and the content you create. By using the tool, you give us permission to process the public comment data needed to run your draw. We handle that data as described in our privacy policy.
Our intellectual property
InstaPicker, including its software, design, and branding, belongs to us. Using the service does not give you any ownership of it. You may not copy, resell, or build a competing product from our tool without our written permission.
Service availability
We work to keep InstaPicker running smoothly, but we cannot promise it will always be available or error-free. We may need to pause the service for maintenance, updates, or reasons beyond our control. We are not liable for losses caused by downtime, though we will always try to keep interruptions short and rare.
Disclaimers
InstaPicker is provided "as is." We do everything we reasonably can to make the draw random and reliable, but we do not guarantee that the service will meet every need or be uninterrupted. You use the tool at your own discretion and remain responsible for your giveaway and your relationship with your entrants.
Limitation of liability
To the fullest extent the law allows, InstaPicker is not liable for indirect, incidental, or consequential damages arising from your use of the service. Where liability cannot be excluded, it is limited to the amount you paid us in the three months before the issue arose.
Your responsibility to us
If your use of InstaPicker, the giveaway you run, or your breach of these terms causes a claim against us from a third party, you agree to cover the reasonable costs and damages we face as a result, to the extent the law allows. In plain terms, if you run a giveaway in a way that gets us dragged into a dispute that was your doing, you are responsible for it.
If part of these terms doesn't hold up
If a court decides that any part of these terms cannot be enforced, the rest of the terms still apply. We would simply treat the problem clause as adjusted to the smallest extent needed to make it valid, and everything else stands.
The whole agreement
These terms, along with our privacy policy and any plan details shown at checkout, make up the full agreement between you and InstaPicker. They replace any earlier understandings about the service.
Transferring this agreement
You may not transfer your account or your rights under these terms to someone else without our permission. We may transfer our rights and obligations, for example if our business is acquired, and if we do, your rights under these terms stay protected.
Ending your access
You can stop using InstaPicker and close your account at any time. We may suspend or end your access if you break these terms or use the service in a way that harms us or other users. If we do, we will tell you the reason where we reasonably can.
Changes to these terms
We may update these terms as the service grows or the law changes. When we make a meaningful change, we will update the date above and, where appropriate, notify you. Continuing to use InstaPicker after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of [insert your jurisdiction]. Any disputes will be handled by the courts of that location, unless local law gives you the right to use your own.
